1.1 These General Terms and Conditions (hereinafter «GTC») apply to all deliveries of goods from natbatt AG, Obergütschstrasse 24, 6003 Lucerne (hereinafter «natbatt»).
1.2 natbatt may change the GTC at any time. The current version available at www.natbatt.ch at the time of the order shall apply.
1.3 All offers are valid as long as they are posted in the online shop and/or a sufficient number of units are available.
1.4 All orders require a minimum age of 18 years. 1.5 Should individual clauses of these GTC or any additional agreements made be or become invalid, this shall not affect the validity of the remaining clauses.
2.1 The product images presented by natbatt before ordering are not binding and are for illustration purposes only.
2.2 All prices quoted in the online shop are final prices, which include all taxes (in particular VAT) and recycling fees (vRG).
2.3 Costs for packaging and delivery are not included in the price, unless otherwise stated.
2.4 natbatt may change the prices quoted in the online shop at any time. The price listed in the online shop at the time of the order shall apply.
3.1 All prices and products listed in the online shop are to be understood as an offer. The purchase contract is void due to delivery obstacles or incorrect price information.
3.2 The purchase contract is concluded with natbatt as soon as the order has been placed in the online shop.
4.1. natbatt assures the customer of a fast order processing. Due to the prevailing logistics structures, it is not possible for natbatt to guarantee generally binding delivery times.
4.2 Commitments regarding delivery times or delivery dates are provisional. natbatt AG attaches great importance to providing up-to-date and accurate information on availability and delivery times in the online shop. In particular, due to production or delivery bottlenecks, delivery delays may occur. All information on availability and delivery time is therefore without guarantee and may change at any time.
4.3 In the event of a delivery delay of more than 60 days from the provisional delivery date, the customer may withdraw from the purchase contract. natbatt will reimburse all amounts already paid from this transaction. There are no further claims on the part of the buyer against natbatt.
5.1 The goods are shipped at the expense and risk of the customer, unless otherwise stated, whereby natbatt chooses the shipping partner. Collection from the natbatt warehouse is only possible under certain conditions and must be requested separately.
5.2 Goods are only shipped to addresses within Switzerland or the Principality of Liechtenstein.
5.3 Delivered goods must be checked immediately for correctness and completeness. The customer must notify natbatt in writing of any incorrectly delivered or incomplete goods within 48 hours of the delivery date. After this period, the delivery shall be deemed approved with regard to content and completeness.
5.4 If no written complaint is made or if it is not made in due time, the delivery in question shall be deemed accepted and the customer shall lose all warranty claims.
5.5 In the event of delivery by a forwarding agent, all complaints must be noted on the delivery note and countersigned.
6.1 natbatt provides a warranty against production or material defects of the delivered goods for 2 years from the date of delivery in accordance with the following provisions. Identified special purchase items are excluded from this, unless otherwise stipulated by law.
6.2 If the delivered goods have a defect, the customer must notify natbatt of this in writing by means of a notice of defect within three working days of receipt of the shipment. If the customer discovers hidden defects after this period, which could not be discovered during a proper inspection, he must notify natbatt of these in writing within three working days of discovery. If no written complaint is made or if it is not made in due time, the delivery in question shall be deemed accepted and the customer shall lose all warranty claims.
6.3 The warranty does not cover damage resulting from improper storage, natural wear and tear, faulty processing and failure to observe regulations. natbatt excludes the warranty obligation if the customer or third parties carry out/undertake modifications, installations or repairs to the delivered goods.
6.4 natbatt rejects any warranty claims for defects that occur after the warranty period of 2 years from delivery.
6.5 If a damage notification proves to be justified, natbatt may, at its own discretion, remedy the defect by repairing the defective goods or by delivering new, defect-free goods.
6.6 Any further claim by the customer due to defective goods, in particular for rescission of the contract, reduction of the purchase price or compensation for direct or indirect damage, is excluded.
6.7 Wear parts such as batteries, rechargeable batteries, power cables or software problems are not covered by the warranty. The other exclusions of liability according to section 7 must be taken into account.
7.1 All liability claims are governed by the applicable statutory provisions.
7.2 Any liability is rejected in the event of: Negligence, consequential damage and loss of profit, missing savings, damage from delayed delivery as well as any actions and omissions of natbatt employees.
7.3 The liability excludes damage resulting from improper storage, natural wear and tear, faulty processing and failure to observe regulations.
7.4 natbatt excludes any liability if the customer or third parties carry out/undertake modifications, installations or repairs to the delivered goods or use incorrect spare parts or accessories.
7.5 natbatt rejects any liability due to force majeure. Force majeure shall include strikes, blockades and lockouts, accidents, fire, earthquakes and other natural disasters, wars, civil wars or insurrections, sabotage, extraordinary official or state measures, interventions, orders or confiscations of any kind, quarantine restrictions, traffic interruptions, third-party fault outside the sphere of influence of natbatt, etc.
8.1 Credit card and TWINT are offered as means of payment in the online shop for private individuals, the respective means of payment is debited when the order is placed. In the case of advance payment, delivery will only take place after receipt of payment. The products in the warehouse are reserved until the payment deadline of at least 11 calendar days.
8.2 The invoice amount must be paid in Swiss francs
9.1 natbatt remains the owner of the goods until full payment of the goods delivery including all ancillary costs incurred in connection with the goods deliveries. If not all outstanding claims have been paid, natbatt is entitled to have a reservation of title entered on the delivered goods at the customer’s expense.
9.2 The customer is obliged to refrain from all actions that would run counter to the objectives pursued with the reservation of title.
10.1 An order placed in the online shop obliges the customer to accept the product.
10.2 Cancellations are only possible as long as no costs have been incurred for natbatt. After this point, the full sales price will be charged.
10.3 Changes to an order must be checked for feasibility with natbatt customer service.
11.1 natbatt allows the return of ordered products within 7 days of the delivery date. Chemical and chemical-technical products cannot be returned.
11.2 The products must be returned in the original packaging with all accessories and must be undamaged. Damaged products will not be taken back.
11.3 The sales price will be charged to the customer. Delivery and return costs shall be borne by the customer.
12.1 Unless otherwise stipulated, the place of performance of services shall be the headquarters of natbatt.
12.2 natbatt is entitled to process and store data that it has received in the context of the business relationship with the customer, regardless of the origin of this data, in accordance with the Data Protection Act.
12.3 The exclusive place of jurisdiction for all disputes potentially resulting from this contract is the headquarters of natbatt. natbatt is entitled to sue the customer at another competent court.
12.4 These GTC and all contracts concluded on the basis thereof are subject to substantive Swiss law.
